1. Introduction
1.1. Deli Cream Ice Cream Ltd., Company No. 515826998 (the “Company”) is the owner of the website: www.delicream.co.il (the “Website”) and operates the mobile application: Deli Cream (the “App”), as well as the owner of the ice cream parlor chain (including, through franchisees) operating under the “Deli Cream” brand and/or any other future brand operating or to operate under the Company (the “Network”).
1.2. The purpose of this Privacy Policy is to explain how the Network handles information provided by users during their use of the Website and/or the App, including how such information is managed, collected, stored, and used, as well as its disclosure to third parties, as detailed below (the “Users” or “User”). The Network places great importance on protecting Users’ privacy and makes every effort to properly safeguard their information and privacy.
1.3. Additionally, this Privacy Policy details the rights of Users regarding information collected about them and their entitlement regarding the information they provide. The Network believes that Users have the right to be informed about the policies and procedures regarding collection and use of information received from them or gathered about them while using the Website and/or the App.
1.4. Use of the Website and/or the App is subject to the Terms of Use as published on the Website and to this Privacy Policy. This Privacy Policy supplements any other written or implied agreement between the User and the Network and constitutes an inseparable part thereof.
1.5. By using the Website and/or the App, the User consents to the terms of this Privacy Policy.
1.6. Users are under no legal obligation to provide information when using the Website. Providing information is subject to the User’s free and informed consent. Users may request deletion or correction of their information held by the Network at any time, subject to Section 2.4 below.
1.7. Subject to applicable law, the Network may, at its sole discretion, amend this Privacy Policy from time to time without prior notice, by updating the Privacy Policy published on the Website and/or the App. Therefore, Users are advised to review the Privacy Policy periodically to remain updated.
1.8. Any reference in this Privacy Policy to the masculine form or singular is made for convenience only and shall apply equally to all Users.
2. Information Collected
2.1. While using the Website and/or the App, the Network may collect two types of information from Users, including through external platforms (as defined below), for the purpose of providing services offered on the Website and the App:
2.1.1. “Personal Information” – Identifiable details such as first and last name, contact information (mobile number and email address), residential address, information regarding available capital (for evaluating the purchase of a franchise license), etc. (i.e., information that enables contacting the User and providing the services offered via the Website and/or the App). Such information is provided knowingly and voluntarily by the User (through active submission) for the purpose of receiving services or information.
For the Customer Club – information for managing the Network’s customer loyalty program (e.g., benefits granted from time to time in accordance with the club’s terms, accumulation of points, redemption of benefits by the User, purchase dates, etc.).
“Non-Personal Information” – Aggregated statistical information that does not enable identification or direct contact with the User, such as information regarding visits and use of the Website, referral sources, length of visits, page views, etc.
(Personal and Non-Personal Information together: the “Information”).
2.2. It is noted that Information provided by the User during use of the Website and/or the App may actually be transmitted to third parties via external platforms integrated into the Website. Accordingly, the Information may be stored both by the Network and by such external platforms, subject to their respective privacy policies.
2.3. The User declares and undertakes that all Information provided, updated, or uploaded during the use of the Website and/or the App is accurate, reliable, and complete, and that it is provided on the User’s own behalf only, unless explicitly authorized to provide such information for another.
2.4. If a User does not wish to provide Information (to the Network and/or to an external platform), or does not agree to the uses described in this Privacy Policy, there is no legal obligation to do so. However, since most Information is required to provide services on the Website and/or App, refusal to provide Information may prevent the User from receiving such services, in whole or in part. In certain cases, Users may choose which Information to provide and for what uses, in which case the Network will inform them of any effect on the services provided.
3. Methods of Collection
3.1. The Network may collect Information about the User while using the Website and/or the App, including:
3.1.1. Contact Us – When Users contact the Network via the Website’s contact form or by email, the Network will collect details such as full name, email address, mobile number, and message content, for purposes of responding to inquiries (e.g., regarding privacy policy, franchise opportunities, private events, etc.).
3.1.2. App Registration for the Customer Club – The Network will collect (including via external platforms) details such as full name, email address, mobile number, date of birth, residential address, and gender, for the purpose of creating a User account in the App.
4. Use of Information Collected
4.1. Generally, the Network collects and uses Information in order to contact Users and provide them with services offered via the Website and/or the App, respond to inquiries (including franchise opportunities), update Users regarding matters for which they provided Information, send service-related updates, and for any other purpose required or permitted by law.
4.2. Additionally, the Network may use Information (subject to applicable law, including the Israeli Telecommunications Law) for direct marketing purposes, such as newsletters, updates, promotional offers, special events, or services from the Network and/or its business partners (“Marketing Updates”).
4.3. Such Marketing Updates may be sent directly by the Network or via external platforms. Distribution of Marketing Updates will be subject to the User’s explicit consent, and Users may opt out at any time by clicking an “unsubscribe” link or contacting the Network directly.
4.4. The Network may also use cookies for proper operation of the Website and/or the App, including statistical analysis, verifying details, customizing the Website/App to User preferences, and security purposes.
4.5. Users may manage or delete cookies at any time via their browser settings, but blocking certain cookies may impair Website functionality. Use of the Website constitutes consent to the use of cookies, without prejudice to the User’s right to manage preferences.
5. Information Collection & Use by External Platforms (Data Processors)
5.1. Certain services provided via the Website and/or the App (e.g., delivery systems, online payments, direct mailing systems, CRM systems, etc.) may be provided by third-party platforms (“External Platforms”). These platforms are integrated into the Website/App and provide complementary services.
5.2. For the purpose of providing services, External Platforms may process, collect, and store Information on behalf of the Network, in accordance with the Network’s instructions and applicable law.
Disclosure of Information to Third Parties
5.3. In order to enable services through External Platforms, the Network may share Personal Information with them. For example, when using an online payment platform, payment details may be transmitted directly to that platform. The Network is not a party to such transactions and Users should review the privacy policies of such platforms before providing Information.
5.4. The Network may also transfer Information to data analytics platforms (e.g., Google Analytics), advertising platforms (e.g., Pixel), and similar technologies.
5.5. Some External Platforms may be located outside of Israel, and therefore Information may be stored abroad, subject to applicable privacy law.
5.6. Accordingly, Information provided to External Platforms is considered provided both to the Network and to the respective platform, and is subject also to that platform’s privacy policy.
5.7. Except as stated herein, the Network will not transfer Personal Information to third parties for their independent use without the User’s prior explicit consent, unless required by law.
5.8. The Network may share Information in the following cases:
- With the User’s consent;
- In cooperation with business partners, including franchisees;
- With entities under common ownership or control with the Network;
- To respond to support or service requests;
- To enforce this Privacy Policy;
- To detect, prevent, or address abuse, security issues, or technical problems;
- To comply with legal requirements;
- In case of corporate transactions (mergers, acquisitions, asset transfers);
- For statistical/aggregate data not personally identifying Users.
6. Information Security
6.1. The Network invests efforts and resources in protecting User Information, using appropriate security measures in line with accepted standards and legal requirements. However, absolute protection cannot be guaranteed. Users acknowledge that the Network shall not be liable for damages or losses resulting from unauthorized access, including privacy breaches.
7. Data Retention
7.1. The Network will retain User Information as long as necessary for the purposes described in this Privacy Policy or as required by law.
7.2. After such period, Personal Information will be deleted or anonymized, unless there is a legitimate or legal need to retain it further.
8. User Rights Regarding Information
8.1. In accordance with the Israeli Privacy Protection Law, Users have the following rights:
- Right of access to their Personal Information held by the Network;
- Right to obtain information about how their data is used;
- Right to correct inaccurate or outdated data;
- Right to request deletion of Personal Information, subject to law;
- Right to object to direct marketing;
- Right to restrict processing in certain cases;
- Right to data portability (receive their data in a structured, machine-readable format and request transfer to another entity).
8.2. Requests concerning these rights or any issue related to this Privacy Policy may be submitted via the contact details below, and the Network will respond within a reasonable time.
9. Children’s Information
9.1. The Network does not knowingly collect Personal Information from children under 16 years old.
9.2. If the Network becomes aware of such collection, it will delete the Information promptly.

11. Governing Law and Jurisdiction
